Suspension lifted for Atlantica Party Association of Nova Scotia

The suspension of the Atlantica Party Association of Nova Scotia which began June 20, 2018 has been lifted by Chief Electoral Officer Richard Temporale, effective August 16, 2018.

On August 15, 2018, Atlantica Party has filed financial reports and provided a plan to rectify issues with a loan made to the Party. Following a review of this documentation, Elections Nova Scotia is satisfied that the Party now meets the requirements of the Elections Act.

As a result, the interim financial statement for the period January 1 to July 31, 2018, with an independent auditor’s report, is published online.

Notice of Compliance Agreement – Atlantica Party Association of Nova Scotia

Chief Electoral Officer Richard Temporale has entered into a Compliance Agreement with Atlantica Party Association of Nova Scotia in connection with breaches of the Elections Act.

 

The Party agrees it did not meet the requirements of the Elections Act when filing its financial statement for 2017. It also agrees that an outstanding $8,811 loan to the Party exceeds the $5,000 limit allowed under the Act. The Party has committed to provide an audited statement for January 1 to July 31, 2018 that meets the requirements of the Act, and to rectify issues with the non-compliant loan. The Party agrees to do so by August 15, 2018.

 

“Atlantica has admitted the facts, accepted responsibility for their actions, and is actively pursuing remedies to the breaches,” says CEO Temporale. “This Compliance Agreement reflects their commitment to resolve the issues that led to their suspension before the extended deadline expires.”

Suspension extended for Atlantica

Chief Electoral Officer Richard Temporale has extended the suspension of the Atlantica Party Association of Nova Scotia.

 

Since the suspension which began June 20th, the party had an opportunity to be heard by Elections Nova Scotia on July 13th. The party has until August 15, 2018 to meet the requirements of the Elections Act or face deregistration effective that date.

Chief Electoral Officer Richard Temporale has suspended the Atlantica Party Association of Nova Scotia effective today.

Under Section 184 of the Elections Act, a registered party shall be suspended if it fails to file financial statements supported by an auditor’s statement. The Chief Electoral Officer is not satisfied that the statement filed to date meets these requirements.

In addition, the party is in breach of the Act on two fronts with respect to an outstanding loan made to the party. A loan must be equal to or less the maximum allowable personal political donation limit in a calendar year ($5,000) and must be repaid in full within two years from the date the loan was issued.

The party must meet the requirements of the Act on or before July 20, 2018 or face deregistration effective that date.

The party has been notified that they will be provided an opportunity to be heard before the effective date of deregistration.
